Explorer Rate Application Hearing Update

Sorry, for the hiatus last week, but the rate application hearing for Explorer Insurance Company (which Steve and I were handling on behalf of the applicant insurer) ended up taking the entirety of last week.  There were a lot of interesting developments from this hearing, which I'll share over the next week or two, once I get the transcripts in.

It should be observed that this rate hearing presents substantial implications for the CDI and the industry.  While it is the second rate application hearing taking place under the new prior approval regulations (following the Allstate rate application hearing), it is the first under which an ALJ (and consequently the Commissioner) will determine whether an insurer will qualify for a constitutional variance under the new regulations.  

As it stands now, the parties are awaiting for the CDI to present additional direct testimony in December.  Cross-Examination of the CDI witness will take place in January 2008, after which the parties will decide whether to file rebuttal testimony and/or agree upon a briefing schedule.
